Can I collect from my ex’s new spouse? Generally no — the new spouse’s income is not directly subject to support obligations. What if the paying parent is paid under the table? Income imputation based on earning capacity is available — past earnings history and industry wages can establish the imputed amount. Can support be collected from an inheritance? Yes — a lump sum inheritance received by the paying parent may be counted as income or assets subject to enforcement. What if there’s an agreement to reduce support informally? Informal agreements don’t modify the court order — only a court order changes the legal obligation.

Informal agreements create risk for custodial parents. A custodial parent who orally agrees to accept less than the ordered amount has not modified the order — but may face a waiver argument later.
