Cryptocurrency presents enforcement challenges but is not untouchable. Courts have ordered disclosure of cryptocurrency holdings, and judges are increasingly sophisticated about digital assets in family law cases.
Enforcement Approaches
Request disclosure of all cryptocurrency accounts and wallets in discovery. Subpoena known exchanges (Coinbase, Kraken, Gemini) for account information. Income from cryptocurrency trading is income for support purposes. Cryptocurrency holdings are assets subject to levy. Courts can order the paying parent to liquidate cryptocurrency and pay support arrears.
Document when the paying parent discloses cryptocurrency holdings. A paying parent who disclosed Bitcoin holdings in a prior proceeding and now claims no assets has a credibility problem. Prior disclosures, combined with blockchain explorer research on known wallet addresses, can establish that assets exist. Family law attorneys with cryptocurrency experience are increasingly available in California.
The California Child Support Recovery System gives custodial parents the exact tools and templates to enforce support orders, calculate arrears, and use every enforcement mechanism available. Request your free evaluation here.
