I already have a DCSS caseworker. Why do I need this kit?
DCSS caseworkers handle massive caseloads. Without specific written requests citing specific statute numbers, many enforcement tools simply don’t get activated. This kit tells you which tools exist, how to request each one by statute name, and how to escalate when your caseworker doesn’t respond.
Can I really use contempt of court without an attorney?
Yes. Form FL-410 (Order to Show Cause for Contempt) is available free from courts.ca.gov and is designed for self-represented parents. Family court self-help centers in every county provide free in-person assistance. The kit walks through the filing process step by step.
The payer claims they can’t afford to pay. What can I do?
California courts can impute income — assign the payer what they are capable of earning based on their education, work history, and the local job market — even if they claim unemployment. Kit Prompt 3 (Income Investigator) analyzes what the payer likely earns and what evidence to gather.
The payer lives in another state. Can California still enforce?
Yes. The Uniform Interstate Family Support Act (UIFSA) provides enforcement across state lines. All 50 states participate. Federal tax intercept and passport denial work regardless of which state the payer lives in. Section 22 covers the full interstate process.
Can old arrears still be collected?
Absolutely. California child support arrears never expire during the children’s minority. After the youngest child turns 18, arrears remain collectible for an additional 10 years. Interest accrues at 10% per year on every unpaid amount.
