Child Support and Immigration Status: What Both Parents Need to Know

Immigration status — of either the custodial or paying parent — does not affect the legal obligation to pay or receive child support in California. California courts have jurisdiction over child support based on the child’s residence and the parents’ connections to California, regardless of immigration status. Understanding this principle protects both parents’ rights and prevents immigration concerns from being used to evade or avoid support obligations.

The Paying Parent’s Immigration Status

A paying parent who is undocumented is still legally obligated to pay court-ordered child support. The fact that their income may be earned informally or in cash doesn’t eliminate the obligation — it makes enforcement more challenging, but the obligation is the same. Courts can impute income to undocumented obligors based on the type of work they perform and local market rates, regardless of whether that income is formally documented.

The Custodial Parent’s Immigration Status

A custodial parent who is undocumented has the same right to file for and receive child support as any other parent. California courts do not require immigration status information to process child support orders. Seeking child support does not create immigration risk for undocumented custodial parents under California’s policies.

Practical Enforcement Considerations

When the paying parent works in the cash economy and has no formal employer, income withholding is unavailable. Bank levy depends on having a bank account, which cash workers may not use.
