Child Support and Stimulus Payments: What Federal Benefit Intercepts Cover

Federal benefit programs — from pandemic-era stimulus payments to ongoing programs like Social Security, unemployment insurance, and federal contractor payments — have varying levels of child support intercept availability. Understanding which federal payments are subject to intercept and how to ensure your case is positioned to capture them is part of a complete federal enforcement strategy.

Federal Tax Refunds: The Primary Federal Intercept

The federal tax refund intercept program, operating through the Treasury Offset Program, is the most significant and consistently available federal intercept mechanism. Arrears of more than $150 (for TANF cases) or $500 (for non-TANF cases) that are certified through DCSS to the federal system are collected from federal tax refunds automatically. This intercept captures federal income tax refunds and can be substantial in years when the obligor receives a large refund.

Federal Contractor and Vendor Payments

The Treasury Offset Program also intercepts payments made by federal agencies to contractors and vendors who owe child support arrears. If the paying parent provides services to the federal government — as a contractor, consultant, or vendor — those federal payments are subject to intercept. DCSS can certify arrears for federal contractor payment offset through the same certification process used for tax refund intercepts.

Unemployment Insurance

Federal unemployment benefits (regular state UI, extended federal programs) are subject to income withholding orders for child support. When the paying parent is receiving unemployment, notify your DCSS caseworker immediately so that a withholding order can be served on the Employment Development Department. UI benefit amounts are modest, but capturing them during periods of unemployment prevents arrears from growing unchecked.

Federal Retirement and Disability Payments

Civil Service Retirement System (CSRS) and Federal Employees Retirement System (FERS) benefits, as well as military retirement pay, are subject to income withholding orders for child support. Federal disability payments through Social Security Disability Insurance (SSDI) are subject to child support withholding, though SSI (Supplemental Security Income) is exempt.
