Child Support Liens on Vehicles and Personal Property

When real property liens and bank levies haven’t produced full collection, California provides additional enforcement mechanisms targeting vehicles, personal property, and titled assets owned by the paying parent. Understanding these less commonly used tools can open collection opportunities that would otherwise be missed.

Vehicle Liens

Motor vehicles registered in California are titled through the Department of Motor Vehicles, and judgment liens can be placed on vehicle titles through a process similar to recording an abstract against real property. A lien on a vehicle title prevents transfer of clean title without satisfaction of the lien — the vehicle cannot be sold or refinanced without paying off your judgment. To place a lien on a vehicle, you need the vehicle’s VIN number and current registration information, which can be obtained through a DMV record request or through discovery in an enforcement proceeding.

Personal Property Levy

A writ of execution can be directed to the county sheriff to levy on personal property owned by the obligor — business equipment, machinery, inventory, valuable collectibles, jewelry, or other tangible assets. The sheriff physically seizes the property, and it is sold at public auction with the proceeds applied to the judgment. Personal property levies are most practical for valuable, identifiable assets — equipment worth thousands of dollars, vehicles, boats — rather than for everyday household goods that are exempt under California exemption laws.

What Is Exempt From Personal Property Levy

California exempts certain personal property from levy: household furniture and personal effects up to $9,525, vehicles up to $3,325 in equity, tools necessary for the trade or profession up to $9,525, health aids, and certain other categories. The exemptions are designed to prevent destitution, not to shield significant assets from collection. A contractor with $50,000 in equipment has exempt tools of the trade up to the statutory limit, with the remainder subject to levy.

Boat and Watercraft Liens

California registers boats through the Department of Motor Vehicles, and judgment liens can be placed on boat titles using a similar process to vehicle liens. A recreational boat is a luxury asset that is fully subject to levy above the applicable exemptions.
