How to Request an Expedited Child Support Hearing in California

Child support hearings are normally scheduled 30 to 60 days after filing. When circumstances require faster action — an obligor who has discovered assets that may disappear, a sudden loss of income creating immediate financial hardship, or an emergency situation affecting the children — California courts have procedures for expedited and emergency hearings that can move on shorter timelines.

Emergency Orders Without Notice

In genuine emergencies — situations where the child’s health, safety, or welfare is at immediate risk — California courts can issue emergency orders without prior notice to the other party. These are called “ex parte” orders. For child support emergencies, this is most commonly used when a custodial parent facing immediate financial crisis can demonstrate that waiting for a normal hearing would cause irreparable harm. The standard for ex parte child support orders is high — courts require a showing of immediate and irreparable harm, not just inconvenience or financial stress.

Expedited Hearings on Regular Notice

More commonly, custodial parents can request expedited hearing scheduling by filing a Request for Order and asking the clerk to calendar it at the earliest available date, or by filing an application for an order shortening time. Courts have discretion to shorten the normal notice periods when there is good cause — an obligor who has announced an intent to transfer assets, a sudden income change requiring immediate modification, or other time-sensitive circumstances.

DCSS can take certain enforcement actions faster than the court system through its administrative authority. For situations requiring quick collection — a known incoming windfall, a soon-to-be-completed real estate sale, an upcoming bonus payment — contact your DCSS caseworker immediately and describe the time-sensitive nature. Administrative bank levies and income withholding can often be executed faster than court-issued orders.
