Childcare Costs and Child Support: What California Law Requires the Paying Parent to Share

Childcare costs are among the largest expenses for working single parents — and California law treats them as a mandatory add-on to guideline child support rather than an expense the custodial parent absorbs alone. Understanding what childcare costs are recoverable, how to document them, and how to enforce payment ensures you’re not bearing costs the other parent is legally required to share.

The Mandatory Add-On

California Family Code Section 4062 designates childcare costs “reasonably necessary” to enable the custodial parent to maintain employment or pursue education or job training as a mandatory add-on to guideline support. “Mandatory” means the court must order cost-sharing — it is not discretionary. The paying parent’s share is typically proportional to their relative income: if they earn 60% of the combined parental income, they pay 60% of the childcare costs.

What Qualifies as Covered Childcare

Covered childcare costs include: daycare and preschool expenses while the custodial parent works, after-school care programs, summer day camps that substitute for school-year childcare, and babysitting costs that are regular and necessary to enable employment. Expenses must be reasonably necessary — not luxury enrichment programs. Overnight childcare or care during periods the child is with the other parent does not qualify. The costs must be documented with receipts and a clear connection to the custodial parent’s employment or training.

How to Enforce Childcare Cost-Sharing

If the paying parent is not complying with a childcare cost-sharing order, unpaid amounts accrue as arrears collectible through standard enforcement mechanisms. Maintain a monthly log of all childcare expenses with receipts, calculate the other parent’s proportional share monthly, and include unpaid childcare amounts in any arrears demand. If there is no current childcare order, file a Request for Order to establish one — particularly if your childcare costs have recently increased significantly.
