The gig economy has created a new generation of income-concealment challenges in child support cases. Drivers, delivery workers, freelancers, and platform-based service providers often have income that doesn’t flow through a traditional employer payroll — making standard income withholding orders less effective and requiring adapted enforcement strategies.
Gig Income Is Fully Subject to Child Support
Income from Uber, Lyft, DoorDash, Instacart, Fiverr, Upwork, TaskRabbit, or any other gig platform is income for child support purposes. There is no exemption for platform-based or independent contractor income. The challenge is enforcement, not legal obligation — the income is owed, but collecting it requires different mechanisms than a standard payroll withholding order.
Income Withholding on Gig Platforms
California has extended income withholding authority to gig platforms operating in the state. DCSS can serve income withholding orders on gig economy platforms — Uber, Lyft, and DoorDash have established procedures for complying with California child support withholding orders. If the paying parent primarily earns through a major gig platform, request that DCSS serve that platform with an income withholding order. Platform compliance varies, and the process is newer and less established than traditional employer withholding, but the legal authority exists.
Bank Deposit Analysis for Gig Income
Gig platform payments typically deposit directly to a bank account. A subpoena to the bank reveals all deposits from the gig platform, establishing actual income regardless of what the obligor reports. Gig platforms also issue 1099-K forms for annual earnings over the reporting threshold — subpoena the platform directly for 1099 records or obtain them through tax return discovery.
Platform Subpoenas
Major gig platforms will respond to valid California court subpoenas for records of payments made to a specific contractor. Subpoena the platform for all payment records covering the relevant enforcement period. This establishes actual income independent of the obligor’s testimony or tax returns, and provides a basis for both the income withholding order and any modification motion.
