Cryptocurrency has become a significant tool for income concealment in child support cases — and California courts and enforcement agencies are increasingly equipped to address it. If you believe the paying parent is earning, holding, or transacting in cryptocurrency, that income and those assets are fully subject to child support calculation and enforcement.
Cryptocurrency Is Income and Property
California law does not create a special category for cryptocurrency. For child support calculation purposes, all income — including cryptocurrency mining income, trading gains, staking rewards, and payments received in crypto — is considered income that factors into the guideline calculation. For enforcement purposes, cryptocurrency holdings are property subject to the same levy and seizure rules as any other asset.
How to Discover Crypto Holdings
Discovering cryptocurrency holdings requires specific investigative steps. At an OEX or in discovery, ask specifically about cryptocurrency holdings by name — Bitcoin, Ethereum, and all other assets. Request production of all exchange account statements (Coinbase, Kraken, Binance US, etc.). Subpoena exchanges directly if the obligor is uncooperative — many US-based exchanges comply with valid court subpoenas. Review tax returns for Schedule D capital gains and Form 8949, which report crypto transactions. Bank statements showing transfers to crypto exchanges are also discoverable.
Enforcing Against Crypto Assets
California courts can order a delinquent parent to liquidate cryptocurrency holdings and pay the proceeds toward arrears. Courts can also order disclosure of wallet addresses and private keys for custodied assets. For exchange-held assets, court orders served on the exchange can freeze and transfer balances. Self-custodied crypto held in hardware wallets is more difficult to enforce against but remains legally subject to court orders — willful concealment of court-ordered asset disclosure is contempt.
The Forensic Approach
Blockchain transactions are public and permanent. A forensic accountant with cryptocurrency expertise can trace transaction flows from known wallet addresses, identifying exchanges used, amounts transferred, and approximate timing. This analysis can establish that the obligor has cryptocurrency assets far exceeding what was disclosed.
