California’s guideline child support formula is income-sensitive. When the paying parent’s income increases significantly, the guideline amount increases — and the custodial parent has the right to seek a modification to reflect that increase.
How to Document the Income Change
Gather: the paying parent’s most recent tax returns, any recent pay stubs available through public records or subpoena, LinkedIn or other employment information showing a new position or promotion, business records if the paying parent is self-employed, and any lifestyle evidence inconsistent with the claimed income.
File promptly when you learn of an income increase. Modification is only retroactive to the date of filing. Every month you wait after learning of a significant income increase is a month of higher support you permanently lose.
